1. Scope and Contracting Party

(hereinafter "Provider") for the use of the mobile application "Swapwise" (hereinafter "App") on iOS, iPadOS, and watchOS, including all associated widgets, extensions, and the Apple Watch companion app.
By downloading, installing, or using the App, you agree to these Terms. If you do not agree to these Terms, please do not use the App.
2. Description of Services
2.1 Free Features
The App provides the following basic features free of charge:
- Conversion between over 160 currencies based on current exchange rates
- Storage of up to 4 favorite currencies
- Daily exchange rate updates (once per calendar day)
- Access to cached exchange rates in offline mode
- Home Screen and Lock Screen widgets
- Apple Watch companion app
2.2 Swapwise Pro (Paid Subscription)
Additional features are available through a paid subscription ("Swapwise Pro"):
- Unlimited favorite currencies
- More frequent exchange rate updates (up to every 30 minutes)
- Access to historical exchange rates with charts (7 time ranges: 1 day to 2 years)
- Camera-based live currency detection and conversion
- Advanced widget features (all Pro widget types)
- Custom quick amounts
- Additional features as described in the current App Store listing
2.3 Subscription Options
Swapwise Pro is available in the following plans:
- Monthly subscription (auto-renewing)
- Lifetime purchase: a one-time purchase with perpetual access
The applicable prices are displayed in the Apple App Store before purchase and may vary by country and currency. Price changes will be announced in the App Store and apply to new subscriptions or to renewals of existing subscriptions.
3. Contract Formation and Subscriptions
3.1 Contract Formation
The contract for the use of the free App features is formed upon downloading and first using the App.
3.2 In-App Purchases
The contract for Swapwise Pro is formed upon completing the in-app purchase through the Apple App Store. Payment processing is handled exclusively by Apple. The Apple Media Services Terms and Conditions additionally apply.
3.3 Auto-Renewal
The monthly subscription automatically renews for the respective period unless cancelled at least 24 hours before the end of the current period. Renewal charges are processed within 24 hours before the end of the current period. The Lifetime purchase is a one-time purchase and does not renew.
3.4 Cancellation
Subscription cancellations are made through the subscription management in your Apple Account settings or through the Apple App Store. After cancellation, access to Swapwise Pro remains active until the end of the paid period. The Provider has no influence over Apple's cancellation processes.
3.5 No Free Trial
Swapwise Pro is offered without a free trial period. The free basic version of the App remains available permanently and without time limit. An upgrade to Swapwise Pro is entirely voluntary and may be made at any time.
4. Exchange Rate Data and Disclaimer
4.1 Informational Purpose Only
The exchange rates displayed in the App are provided for informational purposes only. They do not constitute financial advice, investment recommendations, or solicitations to buy or sell currencies.
4.2 No Guarantee of Accuracy
Exchange rates are sourced from an external data provider (ExchangeRate-API) and cached through an intermediary server. We make no warranty or guarantee regarding the accuracy, completeness, timeliness, or availability of the displayed rates. Exchange rates may differ from actual rates at banks, exchange offices, or other financial service providers.
4.3 No Liability for Financial Decisions
The Provider shall not be liable for financial losses or damages resulting from decisions made on the basis of exchange rates displayed in the App. For binding exchange rates, please consult your bank or financial service provider.
5. Availability and Changes
5.1 Availability
The Provider endeavors to keep the App and its services available at all times. No guarantee of uninterrupted availability is given. In particular, the following circumstances may lead to restrictions:
- Maintenance and updates
- Disruptions to external services (API providers, Apple services, Cloudflare)
- Technical malfunctions or force majeure
- Exceeding rate limiting thresholds (48 requests per 24 hours per device)
5.2 Changes to the App
The Provider reserves the right to modify, expand, or discontinue the App, its features, and these Terms at any time. Users will be notified within the App of material changes to these Terms. Continued use of the App after notification of changes constitutes acceptance of the updated Terms.
5.3 Offline Functionality
The App offers offline functionality using cached exchange rates. These rates may be outdated and serve only as a reference until an internet connection retrieves current data.
6. Intellectual Property
6.1 Copyright
The App, its design, content, graphics, icons, source code, and all related materials are protected by copyright and are the property of the Provider. Any unauthorized reproduction, distribution, modification, or other use is prohibited.
6.2 Trademarks
"Swapwise" and the associated logo are marks of the Provider. Use without express written permission is not permitted.
6.3 License
The Provider grants the User a non-exclusive, non-transferable, revocable license for personal, non-commercial use of the App in accordance with these Terms and the Apple App Store guidelines. Use is limited to Apple devices that the User owns or controls, and only as permitted by the Apple Media Services Terms and Conditions.
7. User Obligations
The User agrees to:
- Not misuse the App, in particular not direct automated mass requests (bots, scraping) to the servers.
- Not attempt to circumvent the App's security mechanisms (including rate limiting and authentication).
- Not decompile, reverse-engineer, or disassemble the App, except to the extent permitted by mandatory applicable law.
- Not use the App for illegal purposes.
- Not commercially use any content or data from the App without permission.
8. Limitation of Liability
8.1 General Limitation
The Provider is liable without limitation for damages resulting from injury to life, body, or health, as well as for damages caused intentionally or through gross negligence.
8.2 Slight Negligence
In cases of slight negligence, the Provider is only liable for breach of material contractual obligations (cardinal obligations). In this case, liability is limited to the foreseeable, typically occurring damage.
8.3 Exclusion of Liability
Otherwise, the Provider's liability is excluded to the extent permitted by law. This applies in particular to:
- Damages caused by incorrect or unavailable exchange rate data
- Damages caused by failures of external services (API providers, Apple, RevenueCat, Cloudflare)
- Lost profits or indirect damages
- Damages caused by unauthorized third-party access to the User's device
- Damages arising from the use of offline functionality with outdated rate data
8.4 Third-Party Liability
The Provider assumes no liability for the services and content of third-party providers (Apple, RevenueCat, ExchangeRate-API, Cloudflare). The respective terms of use and privacy policies of the third-party providers apply.
9. Data Privacy
The processing of personal data is governed by our Privacy Policy, available at https://www.arnoldschreiner.de/swapwise/privacy and in the App under Settings → Privacy Policy.
10. Right of Withdrawal
10.1 Digital Content
For the purchase of Swapwise Pro, the withdrawal rules of the Apple App Store apply. As digital content, the right of withdrawal may expire upon commencement of delivery and your express consent.
10.2 Withdrawal Notice (EU Consumers)
As a consumer within the meaning of applicable EU consumer protection law, you generally have a 14-day right of withdrawal. As transactions are processed through the Apple App Store, Apple's refund policies apply. Refund requests should be directed to Apple at: https://reportaproblem.apple.com
11. Apple-Specific Provisions (EULA)
The following provisions are required pursuant to Apple's minimum terms for End-User License Agreements:
11.1 Acknowledgement
The User and the Provider acknowledge that these Terms are concluded solely between the User and the Provider — and not with Apple Inc. (hereinafter "Apple"). The Provider, not Apple, is solely responsible for the App and its content.
11.2 Scope of License
The license granted to the User for the App is limited to a non-transferable license to use the App on any Apple device that the User owns or controls, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
11.3 Maintenance and Support
The Provider is solely responsible for providing any maintenance and support services with respect to the App. The User and the Provider acknowledge that Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App. Support inquiries should be directed to: swapwise@arnoldschreiner.de
11.4 Warranty
The Provider is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, the User may notify Apple, and Apple will refund the purchase price (if applicable) to the User. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are the sole responsibility of the Provider.
11.5 Product Claims
The User and the Provider acknowledge that the Provider, not Apple, is responsible for addressing any claims of the User or any third party relating to the App, including but not limited to: (i) product liability claims, (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement, and (iii) claims arising under consumer protection, privacy, or similar legislation.
11.6 Intellectual Property
The User and the Provider acknowledge that, in the event of any third-party claim that the App or the User's possession and use of the App infringes that third party's intellectual property rights, the Provider, not Apple, shall be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
11.7 Legal Compliance
The User represents and warrants that (i) they are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and (ii) they are not listed on any U.S. Government list of prohibited or restricted parties.
11.8 Third-Party Beneficiary
The User and the Provider acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms. Upon the User's acceptance of these Terms, Apple shall have the right (and shall be deemed to have accepted that right) to enforce these Terms against the User as a third-party beneficiary thereof.

11.10 Precedence of Apple Terms
The Apple Media Services Terms and Conditions and the Apple App Store Review Guidelines apply in addition to these Terms. In the event of a conflict between these Terms and Apple's terms, Apple's terms shall prevail to the extent they are more favorable to the User.
12. Final Provisions
12.1 Governing Law
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers within the EU/EEA, the mandatory consumer protection provisions of their country of residence remain unaffected.
12.2 Jurisdiction
For disputes with businesses, the place of jurisdiction is the Provider's registered office (Neu Wulmstorf, Germany). For consumers, the statutory provisions apply.
12.3 Dispute Resolution
The European Commission provides an online dispute resolution platform at: https://ec.europa.eu/consumers/odr. We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
12.4 Severability
Should any provision of these Terms be or become invalid or unenforceable, the validity of the remaining provisions shall not be affected. The invalid or unenforceable provision shall be replaced by a valid provision that most closely reflects the economic purpose of the invalid provision.
12.5 Entire Agreement
These Terms, together with the Privacy Policy and the Apple Media Services Terms and Conditions, constitute the entire agreement between the User and the Provider regarding the use of the App.
